Profilio EU s.r.o. (hereinafter referred to as “PROFILIO”) is the operator of the internet service called Profilio, available at the website profil.io (hereinafter referred to as the “Profilio Service”). The Profilio Service enables on the one hand the creation for individual users (hereinafter referred to as the “Users”) - natural persons who are interested in being cast in the role of a performing artist (or the persons representing the performing artist) within the production of audiovisual works, photographs or audio recordings - of user profiles containing their personal data; and on the other hand enables access to the information provided in the user profiles to the partners of PROFILIO - production agencies, photographers, advertising and media agents, film producers, casting agencies or other parties engaged in the production of audiovisual works, photography or other visual recordings, for the purpose of conducting casting activities and finding suitable persons for acting or similar performances (hereinafter referred to as the “Agencies”).
In its activity, PROFILIO is in the position of the controller of personal data towards you, meaning that it decides which personal data to collect, for what purposes and by what means, and is responsible for their proper processing.
We process only the following personal data: (i) data of Users, which the Users themselves provide when completing data in their user profile, and their representatives (including legal guardians with parental responsibility) and (ii) data of Agencies, which the Agencies provided when concluding the contract with PROFILIO, based on which they will be granted access to the information provided in the Users’ user profiles under predefined conditions.
As concerns the personal data of the Users and their representatives, we process the following personal data:
Identification and contact data (name, surname, date of birth, address of residence or contact address, e-mail address, telephone number).
Specifying personal data (User’s preferred roles, information about the User’s territorial limitations and limitations to product types, User’s personal interests, native language, foreign language skills, tolerance of nudity when filming, ethnicity or race).
Information about experience and skills (User’s occupation/profession, acting or other specialisation, sporting skills, skill in playing musical instruments, driver’s license)
Information about physical appearance (eye colour, hair colour and style, height, weight, body type, tattoos - location (photo), piercing, condition of teeth, measures (bust, waist, hips, head), shoe size, dress size, pant length, User’s photographs, audio-visual recordings of Users)
Information about health limitations (physical handicaps)
Information about use of Profilio Services (information about the User’s participation in casting, call-backs, mediation of artistic performances, contracts concluded with Agencies).
Invoicing data (name, surname, company ID number, tax ID number, address of residence or registered office, data about artistic performances).
A detailed catalogue of all of the User’s personal data, which is provided by Users themselves and which we process, is available in Annex No. 1 to this Information.
As concerns the personal data of the Agencies, we process the following personal data:
Identification and contact data of natural persons or representatives of legal entities (name, surname, registered office, company/tax ID number, e-mail address, telephone number)
Information about use of the Profilio Service (information about requirements for Users, about performed casting/call-back with User participation, audiovisual recordings related to filming (e.g. director’s instructions to actors, preferences from the database (preferred profiles, frequently used search terms and keywords), manner of using commands for the purpose of improving the user interface).
Data necessary to process invoicing for use of the Profilio Service (information about concluded agreements, provided services, mediated artistic performance, territorial and temporal extent of use of audiovisual work and information about type of media).
We also process the personal Data obtained when you visit our website profil.io and the applications and forms available there. These are cookies.
The provision of personal data is entirely voluntary on your part, but if you do not provide them, we may not be able to provide you with our full range of services in some cases, or you may not be able to make maximal use the Profilio Service.
We process personal data for the following purposes:
Without your do identification, we would be unable to provide you with our services, because we need to know who you are (e.g. create a user profile, conclude an agreement, place an order, communicate with you). For this purpose, we process your Identification and contact data.

Processing is required to fulfil the controller’s legal obligations
Agencies engaged in selecting suitable individuals for performances within the production of audiovisual works or creation of photographs or other audio and visual recordings select suitable candidates based on their personal features, in particular their appearance, body type, experience and skills, and possibly special characteristics. In order to be able to offer Agencies the Users that they are primarily interested in, we process their Specifying personal data, Information about experience and skills, Information about physical appearance and Information about health limitations.

Consent from data subjects
We may use your personal data within court or administrative proceedings to which we are a party and which concern our legal relationship with you, either at the request of the respective state authority or based on our own initiative when defending and enforcing our legal claims and receivables. We may process your Identification and contact data, Information about use of the Profilio Service and Data needed to process invoicing in this manner.

Processing is required in order to protect our legitimate interests (enforcement of legal claims).
We may use your personal data within court or administrative proceedings to which we are a party and which concern our legal relationship with you, either at the request of the respective state authority or based on our own initiative when defending and enforcing our legal claims and receivables. We may process your Identification and contact data, Information about use of the Profilio Service and Data needed to process invoicing in this manner.
Legal titles for personal data processing:
Processing is required in order to protect our legitimate interests (enforcement of legal claims).
We process your personal data manually and automatically in electronic information systems whilst observing the stipulated security and procedural measures. All employees who come into contact with personal data are duly trained.
We collect all the Users’ personal data and create a database from them, which is accessible only to the Agencies with the option of searching for Users based on the entered criteria. For the purpose of improving our services, we also perform statistical operations and User profiling with the aim of maximally adapting the selection of Users from the database to the Agencies’ requirements and criteria. We also perform facial profiling of your stored photographs with the aim of offering Agencies the preferred biometric facial features.
Identification and contact data, Information about use of the Profilio Service and Data needed to process invoicing are processed for the period of existence of the legal titles for processing, i.e. for the duration of our mutual contractual relationship, and for the term of the applicable statute of limitations (generally three years) pertaining to the rights arising from this legal relationship or related thereto. If you are a User and have not established any legal relationship with us or an Agency (beyond the scope of merely creating an Profilio Service user profile), we will process your Identification and contact data and Information about use of the Profilio Service only for the period of existence of your user profile, which you can cancel at any time.
Specifying personal data, Information about experience and skills, Information about physical appearance and Information about health limitations is processed only for the period of your consent to the processing of these personal data. We shall cease using these data automatically if you cancel your user profile on the Profilio Service. If you remove any of the previously provided personal data from your profile, we shall also automatically cease using this removed personal data.
We use cookies on our website for the purpose of improving the functioning of our website and the setting of certain functions. Cookies are small text files which are saved locally via the browser in the computer. Cookies enable the identification of individual website visitors and the personalisation of their content, and enable the performance of statistical analyses in connection to website visits. We process this information for the period of our legitimate interest in such processing. You can reject the storage of cookies in your browser.
We are assisted in processing personal data by specialised processors with whom we have concluded an agreement on personal data processing and who guarantee the implementation of adequate technical and organisational proceedings so as to meet the legal requirements for personal data processing and to ensure the protection of data subjects’ rights. These processors include in particular:
Users’ personal data is disclosed only to the approved Agencies or Agencies with which we have concluded an agreement on the provision of Profilio Service, under the predefined condition, i.e. firstly in partly anonymized form after entering the search criteria, and subsequently in the form attributable to an identified natural person.
You have the following rights in connection to your personal data processing:
You may withdraw the consent to processing personal data, which you granted us, at any time by notice to the aforementioned e-mail address. We shall cease processing the personal data which we process based on your consent from the moment of receiving your withdrawal.
You have the right to obtain confirmation from us as to whether the personal data concerning your person are or are not processed by us, and the right to access these data. In this connection, you have the right to request the provision of information about the purpose of processing, the categories of processed personal data, recipients of personal data, available information about sources of personal data if they are not obtained directly from you, and period of personal data storage.
You have the right to the rectification of inaccurate personal data relating to you or to the completion of incomplete personal data.
You have the right to have your personal data erased if: (i) they are no longer needed for the aforementioned purposes for which they were collected and processed by us, (ii) you withdraw your consent to personal data processing, in cases where your data are processed based on such consent and there are no other legal grounds for their processing, (iii) you object to the processing of personal data which are processed based on our legitimate interests, and it is found that no such legitimate interests exist, (iv) personal data were processed illegally, (v) stipulated by legal regulations.
You have the right to the temporary restriction of our use of your personal data if: (i) you believe that your personal data which is at our disposal are inaccurate, (ii) the processing of your personal data is illegal, but you do not require their erasure but merely the restriction of their processing, (iii) we no longer need your personal data for the aforementioned purposes, but you need them to determine, exercise or defend legal claims, (iv) you objected to personal data processing because we no longer have any legitimate interests for their processing.
In the cases pursuant to the previous sentence, we shall cease performing any actions with your personal data until the inaccurate personal data are rectified or their inaccuracy is clarified, or until the result of assessing your objection to their processing is resolved.
You have the right to object to the processing of your personal data, which occurs based on our legitimate interest. In this case, we shall cease processing your personal data upon receiving the objection, if we do not have legitimate reasons to continue in such processing.
You have the right to file a complaint to the Office for Personal Data Protection. You can apply this right in particular in cases when you believe that we process your personal data without authorisation or contrary to generally binding legal regulations.
